Breaking Down the Equal Opportunity for All Investors Act of 2023

The securities law as it is currently written, limits who can participate in these investments. However, the U.S. House of Representatives recently passed the Equal Opportunity for All Investors Act of 2023, which would allow U.S. investors an alternative route to participate in private markets and help more people enjoy the benefits of passive real estate investing. If the bipartisan bill becomes law, it would require the SEC to establish an exam for individual investors seeking to attain accredited investor status. 

Currently, individual investors only qualify as accredited if they meet certain financial or professional criteria. The financial requirements include having a net worth that exceeds $1 million (excluding primary residence), an annual income of $200,000 individually/$300,000 jointly of the last two years, or an individual who could demonstrate defined measures of professional knowledge, experience or certifications, such as the series 7, 82 or 65 securities licenses.
